Some would say <em>No\u2026<\/em> The answer to this is more complex than it may seem, so whatever your first answer was, you may want to check this article for a non-radical but rather a common-sense approach to an opt-out in cold <span id=\"urn:enhancement-4136d9fc\" class=\"textannotation disambiguated wl-thing\">email<\/span>.<\/p>\n<h2>What&#8217;s a legal stance on email opt-out?<\/h2>\n<h4>CAN-SPAM ACT (The USA)<\/h4>\n<p>Each <span id=\"urn:enhancement-b6007078\" class=\"textannotation disambiguated wl-thing\">B2B<\/span> cold <span id=\"urn:enhancement-7cd69ac0\" class=\"textannotation disambiguated wl-thing\">email<\/span> including a commercial offer should provide a way for the addressee to sign out of\u00a0further correspondence. A great summary of the CAN-SPAM act interpretation has been\u00a0included in the <a href=\"http:\/\/customer.io\/blog\/Send-email-without-unsubscribe-link-cold.html\" target=\"_blank\" rel=\"noopener noreferrer\">article by <strong>Colin Nederkoorn<\/strong><\/a>\u00a0\u2013 I highly recommend reading this one.<\/p>\n<p>In the same article, Colin points out that probably the easiest way to give your prospects a clear way to opt out is to include an <em>Unsubscribe <\/em>link. At the same time, he also lists 3 following types of <span id=\"urn:enhancement-c1bcd289\" class=\"textannotation disambiguated wl-thing\">emails<\/span> we may send to our prospects:<\/p>\n<p>a) Cold <span id=\"urn:enhancement-66529055\" class=\"textannotation disambiguated wl-thing\">emails<\/span><br \/>\nb) Opt-in marketing messages<br \/>\nc) Transactional messages<\/p>\n<p>There\u2019s no doubt that the b) type of <span id=\"urn:enhancement-5e660254\" class=\"textannotation disambiguated wl-thing\">emails<\/span> should involve an Unsubscribe link. It makes perfect sense \u2013 you\u2019ve subscribed to a newsletter, so you are given an easy way to Unsubscribe. Simple as that. But what about the other types of <span id=\"urn:enhancement-384fa8a6\" class=\"textannotation disambiguated wl-thing\">email<\/span>?<\/p>\n<h4>GDPR (The EU)<\/h4>\n<p>Under GDPR, you should make it clear to the addressee that you\u2019re processing their personal data. The easiest way to do that is putting a short disclaimer at the end of your <span id=\"urn:enhancement-31d321c5\" class=\"textannotation disambiguated wl-thing\">email<\/span>. The disclaimer should fulfill 3 functions:<\/p>\n<ul>\n<li>inform the prospect that you process their personal data;<\/li>\n<li>explain why you\u2019re processing it;<\/li>\n<li>explain how they can change their data or request removing their data from your list.<\/li>\n<\/ul>\n<p>A GDPR-compliant disclaimer may look like that:<\/p>\n<blockquote><p>I chose to contact you because I have strong reasons to assume that you can benefit from what I present in this <span id=\"urn:enhancement-fb88f0f1\" class=\"textannotation disambiguated wl-thing\">email<\/span>. I\u2019m processing your name and <span id=\"urn:enhancement-c186d3f2\" class=\"textannotation disambiguated wl-thing\">email address<\/span> only because I wanted to send you this message. If you want me to change the data I used to contact you, or remove your data from my list, hit reply and let me know.<\/p><\/blockquote>\n<p>That disclaimer checks all the boxes but it could be a little shorter than how I wrote it. It informs the addressee that you process their personal data and tells them why you do that. It also lets them know what to do in case they want to have their personal data removed. But there is no unsubscribe link? Should we include that?<\/p>\n<p>GDPR calls for designing a clear and simple procedure of opting out from receiving correspondence. The two have one thing in common \u2013 if they are badly written and poorly targeted, they can both be SPAM.<\/p>\n<p>And unfortunately for us all, poorly written <span id=\"urn:enhancement-29c105f0\" class=\"textannotation disambiguated wl-thing\">emails<\/span> are not rare. So what I think is that many people confuse the two types \u2013 cold <span id=\"urn:enhancement-e912798f\" class=\"textannotation disambiguated wl-thing\">emails<\/span> and opt-in messages \u2013 because if poorly written, they both\u00a0look and feel like sh*t.<\/p>\n<p>I see\u00a0two tasks for us cold <span id=\"urn:enhancement-5032483d\" class=\"textannotation disambiguated wl-thing\">email<\/span> senders to improve this unfortunate situation:<\/p>\n<ol>\n<li>We need to write great cold <span id=\"urn:enhancement-4340a7fb\" class=\"textannotation disambiguated wl-thing\">emails<\/span> as well as send awesome newsletters \u2013 both highly personalized and genuinely valuable to our addressees.<\/li>\n<li>We need to notice the difference between the two to let our prospects notice the difference.<\/li>\n<\/ol>\n<h3>So, in a nutshell, what\u2019s the difference between the two?<\/h3>\n<p>Firstly, whereas newsletters\u2019 addressees intentionally opted-in for a list of subscribers, cold <span id=\"urn:enhancement-85dd7659\" class=\"textannotation disambiguated wl-thing\">emails<\/span>\u2019 addressees did not. Cold <span id=\"urn:enhancement-40ac9225\" class=\"textannotation disambiguated wl-thing\">emails<\/span> are, by definition, sent to people who have\u00a0not had a previous contact with us, our company or\u00a0its services. They have\u00a0not subscribed to anything.<\/p>\n<p>So providing the\u00a0<em>Unsubscribe<\/em> link at the end of our cold message, as opposed to our newsletter email, is simply illogical and may be confusing to the addressee.<\/p>\n<p>Secondly, whereas newsletters are in definition sent to a large group of people at the same time, the addressees expect a mass message (which should nonetheless involve valuable content as well-personalized as possible). On the other hand, the cold <span id=\"urn:enhancement-944bace5\" class=\"textannotation disambiguated wl-thing\">email<\/span> addressees do not expect anything, as they have no idea they are going to get our message until they actually get it.<\/p>\n<p>The key to a valuable cold <span id=\"urn:enhancement-d50a6085\" class=\"textannotation disambiguated wl-thing\">email<\/span> which\u00a0will be actually welcome in someone\u2019s mailbox is <a title=\"How to Make My Cold Emails Personal? Vol.1: Research on My Prospects\" href=\"https:\/\/woodpecker.co\/blog\/cold-email\/how-to-make-my-cold-emails-personal-vol-1-research\/\" target=\"_blank\" rel=\"noopener noreferrer\">personalization<\/a>. The message HAS TO look personal. Full stop.<\/p>\n<p>And have you ever got a personal <span id=\"urn:enhancement-ca754bcb\" class=\"textannotation disambiguated wl-thing\">email<\/span> including an <em>Unsubscribe<\/em> link at the end? That would be just ridiculous, right? So&#8230;<\/p>\n<h2>What opt-out language to use instead of the <em>Unsubscribe<\/em> link?<\/h2>\n<p>Still, according to the CAN-SPAM act and GDPR, the addressee of a cold <span id=\"urn:enhancement-718231d1\" class=\"textannotation disambiguated wl-thing\">email<\/span> should be provided with a way to opt out (and additionally for GDPR, that you process their personal data). What can we do to avoid writing the word unsubscribe like we do in newsletters?<\/p>\n<p>There are a few ways to solve that problem within the copy of our <span id=\"urn:enhancement-3664bb2\" class=\"textannotation disambiguated wl-thing\">email<\/span>. Here are some examples from the <span id=\"urn:enhancement-400a7333\" class=\"textannotation disambiguated wl-thing\">emails<\/span> I actually got:<\/p>\n<h3>Disclaimer below the signature<\/h3>\n<p><a href=\"https:\/\/woodpecker.co\/blog\/wp-content\/uploads\/2015\/07\/Opt-out-Diclaimer.jpg\"><\/p>\n<img decoding=\"async\" loading=\"lazy\" class=\"alignnone wp-image-760 size-full\" src=\"https:\/\/woodpecker.co\/blog\/app\/uploads\/2015\/07\/Opt-out-Diclaimer.jpg\" alt=\"Opt-out-Diclaimer\" width=\"628\" height=\"194\" srcset=\"https:\/\/woodpecker.co\/blog\/app\/uploads\/2015\/07\/Opt-out-Diclaimer.jpg 628w, https:\/\/woodpecker.co\/blog\/app\/uploads\/2015\/07\/Opt-out-Diclaimer-300x93.jpg 300w\" sizes=\"(max-width: 628px) 100vw, 628px\" \/><\/a><\/p>\n<p>Well, someone had good intentions here, but this one looks kind of scary, actually. First of all, it\u2019s 6 lines of fine print \u2013 no one likes fine print because it smells like some kind of scam.<\/p>\n<p>Second of all, it\u2019s 6\u00a0lines of generic, legal gibberish. No one wants to read that. And you need people to read your <span id=\"urn:enhancement-4b2d7c7b\" class=\"textannotation disambiguated wl-thing\">emails<\/span> if you want them to reply to you.<\/p>\n<p>Third of all, it\u2019s in red\u2026 Red means trouble. Red usually means we did something wrong, or are about to do something wrong. Everyone avoids trouble \u2013 so the addressee of such a message would most probably DELETE this <span id=\"urn:enhancement-98a56875\" class=\"textannotation disambiguated wl-thing\">email<\/span>.<\/p>\n<p>All in all, someone avoided the\u00a0<em>Unsubscribe<\/em> link but instead offered a solution that causes even more trouble.<\/p>\n<p>Here\u2019s a disclaimer from another <a href=\"https:\/\/woodpecker.co\/blog\/how-to-write-a-cold-email-that-actually-works-six-step-tutorial\/\"><span id=\"urn:enhancement-7e959488\" class=\"textannotation disambiguated wl-thing\">email<\/span><\/a>:<\/p>\n<p><a href=\"https:\/\/woodpecker.co\/blog\/wp-content\/uploads\/2015\/07\/Opt-out-Diclaimer21.png\"><\/p>\n<img decoding=\"async\" loading=\"lazy\" class=\"alignnone wp-image-766 size-full\" src=\"https:\/\/woodpecker.co\/blog\/app\/uploads\/2015\/07\/Opt-out-Diclaimer21.png\" alt=\"Opt-out-Diclaimer2\" width=\"499\" height=\"112\" srcset=\"https:\/\/woodpecker.co\/blog\/app\/uploads\/2015\/07\/Opt-out-Diclaimer21.png 499w, https:\/\/woodpecker.co\/blog\/app\/uploads\/2015\/07\/Opt-out-Diclaimer21-300x67.png 300w\" sizes=\"(max-width: 499px) 100vw, 499px\" \/><\/a><\/p>\n<p>Looks better in terms of the language simplicity, but why is it in a light-grey fine print, so I can barely see it? I had to put the awful red arrow here to make sure you can see it.<\/p>\n<p>Don\u2019t do things like that if you want your addressees to treat your message seriously. That\u2019s NOT how you gain trust (or replies, for that matter). The difference is that this one sounds more human and friendly. I also got a cold email once with post scriptum like:<\/p>\n<p style=\"padding-left: 30px;\"><em>\u201cIf you\u2019re not the right person to contact for this, please let me know.\u201d<\/em><\/p>\n<p>Works the same way.\u00a0Remember though to put the info that you processing the personal data to be GDPR complaint when you send emails to the EU. Let&#8217;s say, for instance:<\/p>\n<p style=\"padding-left: 30px;\"><em>\u201cLet me know if you\u2019d be interested in this.\u201d<\/em><\/p>\n<p>The only thing the prospect needs to do to opt out from further messages is to reply with: <em>\u201cI\u2019m not interested. Thanks.\u201d<\/em> Or something similar, like <em>\u201cNO\u201d<\/em> \u2026 \ud83d\ude42<\/p>\n<p>But don\u2019t worry, if they reply with &#8220;<em>no&#8221;<\/em> they do that because they simply don\u2019t have time to spend on pleasantries. But nowadays, that method is used way too\u00a0often. So it has to match the other parts. It has to be human. It has to be natural. It has to match the personal tone of your email.<\/p>\n<p>Think of something light and creative before you ruin your whole message with a word Unsubscribe or a legal formula in the red fine print. There are some more pleasant ways to give your prospects a clear way out of further correspondence.<\/p>\n<p>Come up with your own, original idea for that, and paradoxically you can gain a lot with the part of your email that\u2019s supposed to let people resign.
